DONATIONS
“for you” Foundation,
Inc. will accept any domination size as a donation.
Donations are critical to the survival of most
nonprofits. For that reason, it is not uncommon for charitable organizations to
reach out potential donors in times of financial need. In these instances,
donors may be persuaded to provide support in exchange for some assurance that
the money will be used solely for the requested purpose. Placing restrictions
on the donation helps serve this objective, with the restrictions being either
temporary or permanent in nature.
Characterizing the
Donation
Donations received by a nonprofit organization
can be either unrestricted, temporarily restricted or permanently restricted.
Unrestricted donations can be used for any purpose consistent with the mission
of the nonprofit. Temporarily restricted donations and permanently restricted
must be used for a purpose stated in the gift instrument. The gift instrument
is a document describing the required use of the funds, and is often in the
form of an award letter from a foundation or letter from a single donor. The
decision to place any restriction on the award is at the donor's discretion and
is often in response to the nature of the request from the nonprofit.
Temporary Restrictions
Funds donated to a nonprofit may be temporarily
restricted. Temporarily restricted funds may be either time restricted or
purpose restricted. If the donation is time restricted, the funds must be used
in a specified manner for a period of time. An example would be a grant of
$25,000 for two years to provide operating support to a nonprofit. Purpose
restrictions limit the use of donations to support a particular objective. An
example would be a grant of $25,000 to support the renovation of an athletic
facility for a nonprofit basketball camp. For both types of temporary
restrictions, after the time period passes or the purpose has been completed,
the funds become unrestricted and can be used for any purpose that conforms with the mission of the nonprofit.
Permanent Restrictions
A donor may place a permanent restriction on
funds donated to the nonprofit. In contrast to temporary restrictions,
permanently restricted donations use the interest accumulated on donated funds
as financial support for an indefinite period. Provided the nonprofit uses the
funds in a manner specified in the gift instrument, the funding is
theoretically forever. An example would be a donation of $50,000 to be held by
a nonprofit summer camp with the annual interest generated being used to
support scholarships for low-income campers.
The Internal Revenue Service has strict rules
governing donations of non-cash property to tax-exempt nonprofit organizations.
For gifts of property valued at over $250, the organization must provide the
donor with a written acknowledgment of the donation that includes information
required by the IRS. The organization is required only to acknowledge receipt
of the property; it should not use the acknowledgment to establish the
property's value. It is the donor's responsibility to establish the fair market
value -- or FMV -- of the donated property based on IRS rules and to indicate
the value when the deduction is listed on the donor's tax return. If the
organization or the donor fails to follow the rules, the donor can lose the
right to deduct the donation, and both parties can face IRS fines and
penalties.
Management
Certain accounting measures must be taken
regarding temporary and permanent restrictions on donated funds. While the
limitation is in effect, restricted funds should be kept in a separate account,
to avoid misuse or commingling of the donation. For temporary restrictions,
once the time period has been met or purpose achieved, the restriction is
"released" and the funds are to be transferred to an unrestricted
account. Special accounting considerations apply to multiyear grants, which
require release of funds on an annual basis. For example, for a four-year
$100,000 operating grant, $25,000 would be released and transferred each year, regardless
of when the funds are actually expended.
Gifts of
Property Worth $250 or More
Step 1
Prepare a written communication acknowledging
receipt of the donation of property. This written communication can be a formal
receipt, letter, email or any other written format that conveys the essential
information. The communication must include the name of the charity, the date
of the contribution and a description of the property donated. Do not include
an estimate of the value of the donated property on the receipt.
Step 2
Include a statement on the acknowledgment that
no goods or services were provided by the organization in return for the
donation, if that was the case; alternatively, provide a description and
good-faith estimate of the value of goods or services that the organization
provided in return for the donation. For example, if a donor donates a antique clock and the
organization provides the donor with tickets to a concert in exchange, the
communication must indicate the value of the tickets and that they were
provided in exchange for the donation.
Step 3
Send the written communication to the donor no
later than January 31 of the year following the donation. This enables the
donor to use the receipt to file his tax returns.
Step 4
File Form 8282, Donee
Information Return, with the IRS if the organization sells, transfers,
exchanges or otherwise disposes of the donated property within three years of
the date of receipt of the property. This form tells the IRS the actual value
of the property when it was sold so the agency can compare it to the FMV
estimate that was used by the donor.
Vehicle Donations
Step 1
Prepare IRS Form 1098-C, Contributions of Motor
Vehicles, Boats, and Airplanes or a substitute document containing the same
information for any donation of a vehicle with a claimed value of more than
$500. The form requests key information about the vehicle and its current value
so the IRS can substantiate the donation.
Step 2
Send copies B and C of Form 1098-C to the donor
for his records. If the organization keeps and uses the vehicle, the copies
must be sent to the donor within 30 days of the donation. If the organization
sells the vehicle for cash, send the copies within 30 days of the sale of the
vehicle.
Step 3
Mail copy A of IRS Form 1098-C, Contributions
of Motor Vehicles, Boats, and Airplanes or a substitute document to the IRS by
February 28 of the year following the donation. Use the address for the
Internal Revenue Service Center that process paperwork for your area of the
country that is listed in the instructions to the form

When you buy and install a new product, we may
ask you to register your purchase electronically. When you do, we merge your
registration information with any information you've already left with us (we
call that information your personal profile). If you haven't previously
registered with us, we create a personal profile for you from your product
registration information. If you ever want to review or update that
information, you can visit the Profile Center, click on Update Profile, and
edit any of the Personal Information in your profile. If you haven't already
created a Registration ID, we will ask you to do so. This ensures that only you

CUSTOMER
PROFILES
As mentioned above, every registered customer
has a unique personal profile. Each profile is assigned a unique personal
identification number, which helps us ensure that only you can access your profile.
When you register, we create your profile,
assign a personal identification number, then send
this personal identification number back to your hard drive in the form of a
cookie, which is a very small bit of code. This code is uniquely yours. It is
your passport to seamless travel across www.911ec.org, allowing you to download
free software, order free newsletters, and visit premium sites without having
to fill out registration forms with information you've already provided. Even
if you switch computers, you won't have to re-register – just use your
Registration ID to identify yourself.
WHAT WE

("TOU"). “for you” Foundation, Inc. is a

to update the TOU at any time without notice to User. The most current version
of the TOU can be reviewed by clicking on the "Terms of Use"
hypertext link located at the bottom of our Web pages.
A. This
Agreement, which incorporates by reference other provisions applicable to use
of www.911ec.org, including, but not limited to, supplemental terms and
conditions set forth hereof ("Supplemental Terms") governing the use
of certain specific material contained in www.911ec.org, sets forth the terms
and conditions that apply to use of www.911ec.org by User. By using “for you”
Foundation, Inc. is a Non-Profit 501(c)3 Charity
Private International Foundation (other than to read this Agreement for the
first time), User agrees to comply with all of the terms and conditions hereof.
The right to use www.911ec.org is personal to User and is not transferable to
any other person or entity. User is responsible for all use of User's Account
(under any screen name or password) and for ensuring that all use of User's
Account complies fully with the provisions of this Agreement. User shall be
responsible for protecting the confidentiality of User's password(s), if any.
B. “for
you” Foundation, Inc. is a Non-Profit 501(c)3 Charity
Private International Foundation shall have the right at any time to change or
discontinue any aspect or feature of www.911ec.org, including, but not limited
to, content, hours of availability, and equipment needed for access or use.
2. CHANGED TERMS
“for you” Foundation, Inc. is a Non-Profit
501(c)3 Charity Private International Foundation shall have the right at any
time to change or modify the terms and conditions applicable to User's use of
www.911ec.org, or any part thereof, or to impose new conditions, including, but
not limited to, adding fees and charges for use. Such changes, modifications,
additions or deletions shall be effective immediately upon notice thereof,
which may be given by means including, but not limited to, posting on
www.911ec.org, or by electronic or conventional mail, or by any other means by
which User obtains notice thereof. Any use of www.911ec.org by User after such
notice shall be deemed to constitute acceptance by User of such changes,
modifications or additions.
3. DESCRIPTION OF SERVICES
Through its Web property, “for you” Foundation,
Inc. is a Non-Profit 501(c)3 Charity Private
International Foundation provides User with access to a variety of resources,
including download areas, communication forums and product information (collectively
"Services"). The Services, including any updates, enhancements, new
features, and/or the addition of any new Web properties, are subject to the
TOU.
4. EQUIPMENT
User shall be responsible for obtaining and
maintaining all telephone, computer hardware, software and other equipment
needed for access to and use of www.911ec.org and all charges related thereto.
5. USER CONDUCT
A. User
shall use www.911ec.org for lawful purposes only. User shall not post or
transmit through www.911ec.org any material which violates or infringes in any
way upon the rights of others, which is unlawful, threatening, abusive,
defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane
or otherwise objectionable, which encourages conduct that would constitute a
criminal offense, give rise to civil liability or otherwise violate any law, or
which, without “for you” Foundation, Inc. is a Non-Profit 501(c)3 Charity
Private International Foundation 's express prior approval, contains
advertising or any solicitation with respect to products or services. Any
conduct by a User that in “for you” Foundation, Inc. is a Non-Profit 501(c)3 Charity Private International Foundation 's discretion
restricts or inhibits any other User from using or enjoying www.911ec.org will
not be permitted. User shall not use www.911ec.org to advertise or perform any
commercial solicitation, including, but not limited to, the solicitation of
users to become subscribers of other on-line information services competitive
with “for you” Foundation, Inc. is a Non-Profit 501(c)3
Charity Private International Foundation.
B. www.911ec.org
contains copyrighted material, trademarks and other proprietary information,
including, but not limited to, text, software, photos, video, graphics, music
and sound, and the entire contents of www.911ec.org are copyrighted as a
collective work under the United States copyright laws. “for
you” Foundation, Inc. is a Non-Profit 501(c)3 Charity Private International
Foundation owns a copyright in the selection, coordination, arrangement and
enhancement of such content, as well as in the content original to it. User may
not modify, publish, transmit, participate in the transfer or sale, create
derivative works, or in any way exploit, any of the content, in whole or in
part. User may download copyrighted material for User's personal use only.
Except as otherwise expressly permitted under copyright law, no copying,
redistribution, retransmission, publication or commercial exploitation of
downloaded material will be permitted without the express permission of “for
you” Foundation, Inc. is a Non-Profit 501(c)3 Charity Private International
Foundation and the copyright owner. In the event of any permitted copying,
redistribution or publication of copyrighted material, no changes in or
deletion of author attribution, trademark legend or copyright notice shall be
made. User acknowledges that it does not acquire any ownership rights by
downloading copyrighted material.
C. User
shall not upload, post or otherwise make available on www.911ec.org any
material protected by copyright, trademark or other proprietary right without
the express permission of the owner of the copyright, trademark or other
proprietary right and the burden of determining that any material is not protected
by copyright rests with User. User shall be solely liable for any damage
resulting from any infringement of copyrights, proprietary rights, or any other
harm resulting from such a submission. By submitting material to any public
area of www.911ec.org, User automatically grants, or warrants that the owner of
such material has expressly granted “for you” Foundation, Inc. is a Non-Profit
501(c)3 Charity Private International Foundation the royalty-free, perpetual,
irrevocable, non-exclusive right and license to use, reproduce, modify, adapt,
publish, translate and distribute such material (in whole or in part) worldwide
and/or to incorporate it in other works in any form, media or technology now
known or hereafter developed for the full term of any copyright that may exist
in such material. User also permits any other User to access, view, store or reproduce the material for that User's personal
use. User hereby grants “for you” Foundation, Inc. is a Non-Profit 501(c)3 Charity Private International Foundation the right to
edit, copy, publish and distribute any material made available on www.911ec.org
by User.
D. The
foregoing provisions of Section 5 are for the benefit of “for you” Foundation,
Inc. is a Non-Profit 501(c)3 Charity Private International Foundation, its
subsidiaries, affiliates and its third party content providers and licensors
and each shall have the right to assert and enforce such provisions directly or
on its own behalf.
6. USE OF SERVICES
The Services may contain email services,
bulletin board services, chat areas, news groups, forums, communities, personal
web pages, calendars, photo albums, file cabinets and/or other message or
communication facilities designed to enable User to communicate with others
(each a "Communication Service" and collectively "Communication
Services"). User agrees to use the Communication Services only to post,
send and receive messages and material that are proper and, when applicable,
related to the particular Communication Service. By way of example, and not as
a limitation, User agrees that when using the Communication Services, User will
not:
Use
the Communication Services in connection with surveys, contests, pyramid
schemes, chain letters, junk email, spamming or any duplicative or unsolicited
messages (commercial or otherwise).
Defame,
abuse, harass, stalk, threaten or otherwise violate the legal rights (such as
rights of privacy and publicity) of others.
Publish,
post, upload, distribute or disseminate any inappropriate, profane, defamatory,
obscene, indecent or unlawful topic, name, material or information.
Upload,
or otherwise make available, files that contain images, photographs, software
or other material protected by intellectual property laws, including, by way of
example, and not as limitation, copyright or trademark laws (or by rights of
privacy or publicity) unless User own or control the rights thereto or have
received all necessary consent to do the same.
Use
any material or information, including images or photographs, which are made
available through the Services in any manner that infringes any copyright,
trademark, patent, trade secret, or other proprietary right of any party.
Upload
files that contain viruses, Trojan horses, worms, time bombs, cancel bots,
corrupted files, or any other similar software or programs that may damage the
operation of another's computer or property of another.
Advertise
or offer to sell or buy any goods or services for any business purpose, unless
such Communication Services specifically allows such messages.
Download
any file posted by another user of a Communication Service that User know, or
reasonably should know, cannot be legally reproduced, displayed, performed,
and/or distributed in such manner.
Falsify
or delete any copyright management information, such as author attributions,
legal or other proper notices or proprietary designations or labels of the
origin or source of software or other material contained in a file that is
uploaded.
Restrict
or inhibit any other user from using and enjoying the Communication Services.
Violate
any code of conduct or other guidelines which may be applicable for any
particular Communication Service.
Harvest
or otherwise collect information about others, including email addresses.
Violate
any applicable laws or regulations.
Create
a false identity for the purpose of misleading others.
Use,
download or otherwise copy, or provide (whether or not for a fee) to a person
or entity any directory of users of the Services or other user or usage
information or any portion thereof.

Inc. is a Non-Profit 501(c)3 Charity Private International Foundation has no
obligation to monitor the Communication Services. However, “for you”
Foundation, Inc. is a Non-Profit 501(c)3 Charity
Private International Foundation reserves the right to review materials posted
to the Communication Services and to remove any materials in its sole
discretion. “for you” Foundation, Inc. is a Non-Profit
501(c)3 Charity Private International Foundation reserves the right to
terminate User’s access to any or all of the Communication Services at any
time, without notice, for any reason whatsoever. “for you” Foundation, Inc. is
a Non-Profit 501(c)3 Charity Private International
Foundation reserves the right at all times to disclose any information as it
deems necessary to satisfy any applicable law, regulation, legal process or
governmental request, or to edit, refuse to post or to remove any information
or materials, in whole or in part, in “for you” Foundation, Inc. is a
Non-Profit 501(c)3 Charity Private International Foundation's sole discretion.
Materials uploaded to the Communication
Services may be subject to posted limitations on usage, reproduction and/or
dissemination; User is responsible for adhering to such limitations if User
downloads the materials.
Always use caution when giving out any
personally identifiable information in any Communication Services. “for you”

Private International Foundation does not control or endorse the content,
messages or information found in any Communication Services and, therefore,

in any Communication Services. Managers and hosts are not authorized “for you”

7. MEMBER ACCOUNT, PASSWORD, AND SECURITY
If any of the Services requires User to open an
account, User must complete the registration process by providing “for you”
Foundation, Inc. is a Non-Profit 501(c)3 Charity
Private International Foundation with current, complete and accurate
information as prompted by the applicable registration form. User also will
choose a password and a user name. User is entirely responsible for maintaining
the confidentiality of User’s password and account. Furthermore, User is
entirely responsible for any and all activities that occur under User’s
account. User agrees to notify “for you” Foundation, Inc. is a Non-Profit 501(c)3 Charity Private International Foundation immediately of
any unauthorized use of User’s account or any other breach of security. “for
you” Foundation, Inc. is a Non-Profit 501(c)3 Charity Private International
Foundation will not be liable for any loss that User may incur as a result of
someone else using User’s password or account, either with or without User’s
knowledge. However, User could be held liable for losses incurred by “for you”
Foundation, Inc. is a Non-Profit 501(c)3 Charity Private International
Foundation or another party due to someone else using User’s account or
password. User may not use anyone else's account at any time, without the

Private International Foundation shall have the right in its sole discretion to

expenses, including attorneys' fees, arising out of the use of “for you”

17. TERMINATION
Either “for you” Foundation, Inc. is a
Non-Profit 501(c)3 Charity Private International
Foundation or User may terminate this Agreement at any time. Without limiting
the foregoing, “for you” Foundation, Inc. is a Non-Profit 501(c)3 Charity Private International Foundation shall have the
right to immediately terminate User's Account in the event of any conduct by
User which “for you” Foundation, Inc. is a Non-Profit 501(c)3 Charity Private
International Foundation, in its sole discretion, considers to be unacceptable,
or in the event of any breach by User of this Agreement.
18. MISCELLANEOUS
This Agreement and any operating rules for
